THE LEGAL STUFF (I hate this as much as you do) 

I know, I know... in an ideal world this page wouldn't be needed, but alas the world isn't ideal and this has to be displayed somewhere. The important bit is the Renter's Agreement. In short, this says you agree that your use of the apartment and the surrounding grounds is at your own risk entirely and if you booked via Airbnb you agree to be bound by their terms & conditions too. After that it's the usual GDPR stuff. It's all pretty standard, so here we go...

Renter's Agreement​

Definitions: "Guest" or "Guests" means the person renting or using the property and anyone who joins that person in the property. "The Property" means the apartment at Ironworks which is rented to or used by the Guests. "The Owner" means the legal owner of the property. "Rental", "Rental Period" and "Use" means the period of time the owner has granted the guests use of the property.

 

1. Guests acknowledge that the use of the property and the surrounding grounds is granted on a casual short-term basis at the sole discretion of the owner and that the use of the property and the surrounding grounds is entirely at the guest's own risk.

2. Guests will at the commencement of their use of the property satisfy themselves that the property is in good and substantial repair.

​

3. Any unsafe or dangerous condition must be reported to the owner immediately.

 

4. Guests shall throughout the period of their use of the property keep the property in a state of cleanliness, good condition and repair.

5. Guests will ensure all doors and windows to the property are locked when they are not in the property.

 

6. Guests shall indemnify and save harmless the owner against and from any and all expenses, costs, damages, suits, actions or liabilities arising from any and all loss of or damage to personal property, injury or death as a consequence of the guest's use of the property, the surrounding grounds and gardens.

 

7. The owner has no responsibility nor liability for any injury, damage or loss however caused to a guest or their possessions including but not limited to vehicles during their use of the property.

8. If an item of equipment or other amenity provided at the property breaks down or becomes unusable, the owner will make every effort to put things right. However, guests acknowledge a remedy might not be possible during their use of the property.

9. If the property is deemed totally unusable, the total liability of the owner to the guests will extend to a refund of no more than the pro-rata rental fee agreed, for the period when the property was deemed totally unusable. Any such fees will be returned to the guests promptly.

10. Guests have full responsibility for fulfilling the terms of this Rental Agreement for the period of their use of the property, and by entering the property guests agree to be bound by the terms of this Rental Agreement in full. If you do not agree to be bound by all of the terms in this Renter's Agreement, do not enter the property!

11. In addition to all the terms and conditions above, guests who book through Airbnb agree to be bound by Airbnb's terms and conditions as set out on their website.

Website Privacy Policy (GDPR)

Definitions: This Privacy Policy applies to your use of this website or websites, herein referred to as the “Website”. The websites are aplaceinthelakes.com and aplaceinthelakes.co.uk. Your use of the Website indicates that you agree to the Privacy Policy, so please read it carefully. The words “We”, “Us and “Our” refer to the owner of this Website. As used in this policy, “Personal Information” is data that can identify a particular person or device. Aggregate data isn’t considered Personal Information.

 

1. We never collect your personal information except to communicate with you.

Our Website doesn't collect any of your Personal Information. Unlike most websites, our site doesn’t collect your IP address. We do detect non-personally identifiable geo-location information to optimize our services, but we definitely don't collect your precise geo-location or associate geo-location information with a particular user.

Because we do not collect information about your online activities over time and across third-party websites or online services, there is no need for us to respond to a browser’s Do Not Track settings, although we strongly support a consumer’s right to set such a preference and encourage all website operators to honour this consumer choice.

We may request your email address or phone number to communicate with you. This information is used only as you’d expect and will be deleted upon request.

 

2. We use Wix.com to build and host this website. Wix has its own Privacy Policy and Terms & Conditions which are separate from ours. We have no control over Wix's Privacy Policy or its Terms & Conditions which can be found at Wix.com. Your continued use of our website signifies your acceptance of Wix's Privacy Policy and its Terms & Conditions. 

 

3. We will never sell your email address or any other personal information you volunteer.

We do not receive payment in cash or in kind from third parties in exchange for your Personal Information. Further, we do not allow third parties to collect information about you on our site through cookies or other means with the exception of Wix.com, as detailed above.

 

4. We share your personal information only in specific circumstances

There are a few, very rare circumstances when we may have to share your Personal Information either to obey the law or protect our rights. We’ll share your Personal Information only to comply with laws or legally enforceable requests, to enforce our own rights and contracts with users or third parties, or to prevent harm to others and their property in an emergency situation. In all instances, we’ll share the minimum information necessary to meet the immediate need and will inform you of our disclosure when legally and practically possible.

 

5. We retain the personal information you volunteer indefinitely.

We store the Personal Information you volunteer so that we can contact you, but we will remove it from our records within 30 days of any request to do so.

 

6. Transparency report.

As explained above, we will comply with a request for user data when the law requires it, but we require valid legal process to compel the disclosure of user data to the government; such as a legitimate and properly scoped court order, or a search warrant supported by probable cause and issued by an appropriate law enforcement authority. We interpret requests narrowly, and we will oppose unlawful or over-broad requests for specific user data.

We may make small, inconsequential changes to this policy with or without notice to you, so you are encouraged to review the policy from time to time.
